Terms of service

Section 1. General provisions

1. These terms set out the rules for using the website available at https://tagtracks.net (the “Website”).
2. The owner of the Website and the service provider is TagTracks Sp. z o.o., registered in Wrocław, Poland, ul. Dyrekcyjna 1/142, 50-528 Wrocław, entered in the register of entrepreneurs of the Polish National Court Register under number KRS 0001226710, tax ID (NIP) 8993052175, statistical number (REGON) 544177480, e-mail: maciej.janiszek@tagtracks.net (the “Provider”).
3. These terms are made available free of charge at this address in a form that allows them to be downloaded, reproduced, stored and printed.
4. Using the Website constitutes acceptance of these terms.

Section 2. Definitions

1. Website - the website available at https://tagtracks.net together with its subpages.
2. User - any person using the Website.
3. Contact form - the tool on the Website that allows an enquiry to be sent to the Provider.
4. Services - the services provided by electronic means described in Section 3.

Section 3. Type and scope of services

The Provider supplies the following services by electronic means:

1. making the content of the Website available, including product descriptions and technical specifications,
2. making datasheets and other materials available for download in PDF format,
3. handling enquiries sent through the contact form.

All services are free of charge. The Website does not sell online - it has no basket, no payment system and no way of concluding a sales contract by electronic means. The service agreement is concluded for a definite period and ends when you leave the Website or, in the case of the form, when the enquiry is sent. You may stop using the Website at any time without giving a reason.

Section 4. Technical requirements

To use the Website you need:

1. a device with internet access,
2. a current version of a web browser with JavaScript enabled,
3. an active e-mail account - if you use the contact form,
4. software able to open PDF files - if you download datasheets.

The Provider notes that using services supplied by electronic means carries typical risks such as malware, phishing and interception of transmissions by unauthorised parties. We recommend using up-to-date antivirus software and an updated browser. The Website runs over an encrypted connection (HTTPS).

Section 5. Rules for using the Website

1. The User shall use the Website in accordance with the law, good practice and these terms.
2. It is prohibited to supply unlawful content, in particular content that is offensive or infringes personal rights or the rights of third parties, as well as to send unsolicited commercial information or third-party personal data through the form without a legal basis.
3. Actions that disrupt the operation of the Website are prohibited, including automated content scraping at a scale that burdens the infrastructure, attempts to circumvent security measures and bulk submissions through the form.
4. In the event of a breach of these rules, the Provider may block access to the Website and, in justified cases, pursue claims under general rules.

Section 6. Nature of the information published on the Website

1. Information about products, including technical parameters, photographs and datasheets, is for information purposes only and does not constitute an offer within the meaning of Art. 66 § 1 of the Polish Civil Code, but an invitation to conclude a contract within the meaning of Art. 71 of the Polish Civil Code.
2. Technical parameters come from manufacturer documentation and may change. Only the arrangements set out in an individual quote or order confirmation are binding.
3. Information about stock availability in Poland is indicative and requires confirmation when an order is placed.
4. The Provider makes every effort to keep the content accurate and up to date but is not liable for decisions taken solely on its basis, without prior contact and confirmation of the product selection.

Section 7. Intellectual property

1. The Website, its layout, texts, photographs, trade marks and logos are legally protected and belong to the Provider or to the entities it works with.
2. Datasheets and materials made available for download may be used to review our offer and for internal technical evaluation.
3. Copying, publishing or otherwise distributing materials from the Website beyond permitted use requires the Provider's prior written consent.

Section 8. Complaints about the Website

1. Complaints concerning the operation of the Website and the services provided by electronic means may be submitted to maciej.janiszek@tagtracks.net.
2. A complaint should describe the problem and include contact details allowing us to reply.
3. The Provider examines a complaint within 14 days of receiving it and replies by the same channel through which it was submitted.
4. The procedure described in this section covers the operation of the Website only. Complaints about purchased goods are governed by separate arrangements between the parties and by the provisions on warranty and guarantee.

Section 9. Personal data

The rules for processing personal data, including data submitted through the contact form, are described in the Privacy policy available on the Website. It forms an integral supplement to these terms.

Section 10. Final provisions

1. Matters not covered by these terms are governed by Polish law, in particular the Civil Code and the Act on Providing Services by Electronic Means.
2. The Provider may amend these terms for important reasons, in particular a change in the law or in the scope of the services provided. Amended terms are published on the Website with a new effective date and are binding from the date of publication. Services started before the change are governed by the version in force when they started.
3. Disputes with Users who are businesses shall be settled by the court having jurisdiction over the Provider's registered office. Disputes with consumers shall be settled by the court determined under general rules.
4. These terms are provided in Polish and English. In the event of any discrepancy, the Polish version prevails.
